TERMS OF TRADE

By agreeing to our services, you agree to the following terms and conditions.

1. PAYMENT TERMS
Unless otherwise agreed upon in advance and confirmed in writing by the
Contractor/Supplier, payment is required on the day the service is provided. We may
request a deposit or full payment in advance before delivering certain services.

2. INTEREST AND LEGAL EXPENSES
If you fail to make a payment by the due date you shall be liable to pay us:
(a) Default interest on the amount outstanding calculated at 2% above the current bank
overdraft interest rate per month, accruing before and after judgment.
(b) All collection expenses, including debt recovery and legal fees, will be added to your
account. A $15.00 administration fee will also apply each month the account remains
overdue.

3. ACCEPTANCE
Any instructions received by the contractor from the client for the supply of goods and/or
services constitutes acceptance of these terms and conditions.

4. OWNERSHIP
Ownership of goods remains with us until full payment is received. You shall hold goods as
a fiduciary owner. If payment defaults or insolvency occurs, we reserve the right to recover
and resell goods without notice.

5. DELIVERY
Delivery is deemed complete upon the customer’s receipt of the service.

6. WARRANTY
Any faults in workmanship must be reported to the contractor within 7 days of service
completion.

7. PRIVACY ACT
7.1 The client authorises the contractor to collect, use and retain personal information for
assessing creditworthiness or enforcing contract rights.
7.2 The contractor may disclose client information for these purposes.

8. PERSONAL PROPERTY SECURITIES ACT 1999
8.1 This agreement constitutes a Security Interest in Personal Property under the PPSA.
8.2 The client waives rights under sections 116, 119, 120(2), 121, 125, 126, 127, 129, 131
and 132 of the Act.

9. CANCELLATION POLICY
Please understand that appointment times are limited. If you must cancel your
appointment, we respectfully request at least 48 hours’ notice. Missed appointments, or
cancellations with less than 48 hours’ notice, may incur a fee of $110.

10. HEALTH & SAFETY
The Contractor is responsible for their own safety and must comply with the Health and
Safety at Work Act 2015 and any relevant policies or procedures of the business.

DEFINITIONS
“Contractor/Supplier” – Chim Chim
“Client” – The person, authorised agent or legal entity described in the application, invoice,
quote or order form, purchasing goods and/or services from Chim Chim.

“Services” – All services provided by the contractor, including advice and
recommendations.
